Misdemeanor Unit

The Misdemeanor Unit prosecutes crimes including Class A through Class D misdemeanors.

It also is responsible for conducting preliminary hearings, detention and bond review hearings, and probation revocation hearings. The Misdemeanor Unit also assists in issuing cases and presenting cases to the grand jury to determine probable cause.

Class A Misdemeanors

Class A misdemeanors are punishable by up to one year in jail and a $2,000 fine. Examples: assault in the fourth degree, rioting, harassment, sexual abuse in the second degree.

Class B Misdemeanors

Class B misdemeanors are punishable by up to six months in jail and a $1,000 fine. Examples: public intoxication, driving while intoxicated, identity theft.

Class C Misdemeanors

Class C misdemeanors are punishable by up to 15 days in jail and a $750 fine. Examples: highway littering, animal neglect, refusal to disperse.

Class D Misdemeanors

Class D misdemeanors are fine-only offenses, with a maximum fine of $500. Examples: driving with a revoked license, unlawful possession of drug paraphernalia, minor in possession of alcohol.

Misdemeanor Fines

The judge can order higher fines than those noted above if a defendant gained money or property as a result of a crime. Defendants can face up to double the amount of the criminal proceeds (money or property). The judge may allow payment of fines in installments.
