Language from Probable Cause Statement: "S.E. was found inside his Mini Cooper automobile after it had crashed into a parked car in the 4400 block of Sexauer. S.E. was found deceased in the car, suffering from gunshot wounds to the chest and lower body. His wallet, which contained a large sum of cash, was found on the floorboard of his car, with apparent blood on it.


Witnesses reported hearing a gunshot, and then seeing the victim in a struggle with a black male who was armed with a handgun; the black male was heard to say to the victim “give it up.” More gunshots were heard, and the victim was observed to enter his automobile and attempt to drive away. The victim’s car crashed into a parked car on the same block. A witness then observed the gunman trying to open the apparently locked doors of the Mini Cooper, and then flee the scene.


Police Sgt. Robert Niemira and other officers found the defendant running through a gangway in the area. The defendant matched the description given by witnesses, and had blood on his clothing, his shoes and on his hands and arms.


Defendant admitted to being at the scene and to shooting the victim during a struggle."
